Introduction

ASPCasting.com/GeniusCasting.com is a private Talent Hunt website. Users can upload their images and videos, making them accessible to the company.

Eligibility

Users must provide true and accurate information and accept the terms and conditions. The use of the service is restricted to persons who are of age 18 or older.

Contestants should be available for all audition rounds and photo sessions on passing the preliminary audition.

  • • Non disclosure agreement of each participant about their result, until the heroine is officially declared.
  • • It is your responsibility to send your pictures and videos on genuine aspcasting.com or geniuscasting.com
  • • If you send your profile or data on wrong address or its hacked and it's been misused than production is not responsible.
  • • No money will be charged and no agent is appointed. You will be directly meeting with the director, Mr. Anil Sharma himself on being selected.
  • • Anil Sharma will be the only authority taking the final call.
  • • If any agent or person asks for money, he/she is a fraud. Production will not be responsible for financial losses.
  • • It is mandatory for contestants to do their video based on the script given on the website.
  • • Contestants can do their free-performance video on any script of their choice.
  • • Video should be shot in such a way, so that we get all the visuals, i.e. full, mid and close-up.
  • • Before the video, contestants should speak about themselves, their profiles, age, education and experience, if any.
  • • Contestants can upload videos shot on their mobile phones as well.
  • • Your photographs are required in full, mid and close-up and profiles.
  • • This is a one-month contest, which starts on 8 September, 2016 and ends on 15th October, 2016

Content policy

  • A. Please choose the material and information you provide on this site carefully, and ensure that the information you provide and the actions you take must not include the following:
    • • Harass, defame, stalk, or in any other way exert pressure, threaten or harm others or any other third party.
    • • Submit material that is copyright protected or otherwise subject to third party proprietary rights, unless you are the owner of such rights or have permission from their rightful owner to post the material.
    • • Submit materials that falsely express or imply that such materials are sponsored or endorsed by any other third party.
    • • Submit material that in any form, contains software viruses or other malicious software such as including but not limited to, Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment and performs any other action that could be unlawful or damage, overburden or compromise the website.
    • • Remove any copyright, trademark or other proprietary rights, notices contained in or on the website and services.
  • B. By submitting a video, you agree that the website has the unrestricted right to use your video, commercially or non-commercially, including the worldwide right to publish and display it in any media for advertising, commercial gain and publicity, all without any review or compensation. Also, the videos, images and personal details submitted will be used by ASPCasting.com/GeniusCasting.com for promotional purposes.
  • By entering, you represent and warrant that you have all the rights, licenses, permissions and consents necessary to submit the video in accordance with the laws of the land.
  • D. You understand that the website reserves the right to use/modify/alter the same as per its requirements without obtaining any approval from you. Also, you understand that the website has all rights to disqualify or refuse to any video at any time at its sole discretion, without giving any reason.

Copyright

You should not submit in any way, any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. In case of the infringement of copyright rights, you should indemnify ASPCasting.com/GeniusCasting.com for any legal case and/or claim for damages along with attorney fees that ASPCasting.com/GeniusCasting.com may face due to copyright infringement by you. ASPCasting.com/GeniusCasting.com respects the copyright of others.

Disclaimer

You agree that you use the website and services at your sole risk. ASPCasting.com/GeniusCasting.com, its partners, employees, consultants and subcontractors disclaim all warranties in connection with your use of the website and services. ASPCasting.com/GeniusCasting.com is not responsible and therefore disclaims any responsibility or liability for the accuracy, completeness, legality or availability of any content posted/submitted on the ASPCasting.com/GeniusCasting.com website or services. ASPCasting.com/GeniusCasting.com disclaims any responsibility for any error, omission, leak, interruption, deletion, defect, failure, theft, destruction or unauthorized access to, or alteration of videos submitted.

Indemnity

You agree to defend, indemnify and hold harmless ASPCasting.com/GeniusCasting.com, its partners, officers, directors, employees, and subcontractors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the ASPCasting.com/GeniusCasting.com website and services; your violation of any term of these terms and conditions or third party rights, including without limitation any copyright, property, or privacy right; or any claim that was caused by content or material posted or shared through you. This defence and indemnification obligation will survive these terms of service and your use of the website or services.

Limitation of Liability

IN NO EVENT SHALL ASPCasting.com/GeniusCasting.com BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ASPCasting.com/GeniusCasting.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Changes to Terms and Conditions

We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Service at any time without further notice, and it is your responsibility to review these Terms of Service for any changes. Your continued use of the website after any such changes constitutes your acceptance of the new Terms of Service.

Miscellaneous

These terms of service together and other legal notice published by ASPCasting.com/GeniusCasting.com constitute the entire agreement between you and ASPCasting.com/GeniusCasting.com with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the terms of service by a party will be effective only if in writing and signed by a party. If any provision of these terms of service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms of service, which shall remain in full force and effect. No waiver of any term of this these terms of service shall be deemed a further or continuing waiver of such term or any other term, and ASPCasting.com/GeniusCasting.com's failure to assert any right or provision under these terms of service shall not constitute a waiver of such right or provision.

This Terms and Conditions shall constitute a legally binding Agreement as per The Indian Contract Act, 1872 with ASPCasting.com/GeniusCasting.com and appropriate courts in Mumbai shall have exclusive jurisdiction for the same.
